Massachusetts rule sheet
| Benefit formula | 60% of your average weekly wage.[1] |
|---|---|
| Maximum weekly | $2,007.20 a week for injuries Oct 1, 2026 – Sep 30, 2027 [2] |
| Minimum weekly | $401.44. If your average weekly wage is below the minimum, compensation equals your wage.[2] |
| How the limits are set | Maximum = 100% and minimum = 20% of the state average weekly wage, set by the Department of Industrial Accidents each October 1. |
| Waiting period | No pay for the first 5 calendar days; if incapacity lasts 21 days or more, it is paid from the first day.[3] |
| How long TTD lasts | §34 TTD: max 156 weeks. Combined §34 + §35: 364 weeks (520 weeks if §35 extension for 75%+ permanent loss etc. is agreed/found).[1] |
| Partial (TPD) | 60% of the difference between pre-injury AWW and the weekly wage the employee is capable of earning after injury, but not more than 75% of the §34 TTD rate the employee would receive; max 260 weeks (extendable to 520); combined §34+§35 max 364 weeks absent extension.[4] |
| Average weekly wage | Earnings during the 12 calendar months immediately preceding the injury divided by 52; if more than two weeks' time lost, divide by remaining weeks. Concurrent insured employers' earnings combined. Fringe benefits (health insurance, pensions etc.) excluded.[5] |
Worked example, Oct 5, 2026

What trips people up in Massachusetts
- TTD is only 60% of AWW (not 2/3) and is capped at 156 weeks.[1]
- Max/min are set by date of injury and reset every October 1.[6]
- Wages from concurrent insured employers are combined in AWW.[5]
- No benefits unless incapacitated 5+ calendar days; days 1-5 are paid back only if incapacity lasts 21+ days.[3]
- Partial benefits may be reduced so combined earnings + benefits do not exceed 2x the state AWW.[4]
