1. An estimate, not a determination
The calculator applies each state's published benefit formula, maximum and minimum to the figures you enter. Your actual compensation rate is set by your employer's insurer, self-insured employer or state fund, and is subject to review by your state's workers' compensation agency. The official average weekly wage is calculated from payroll records under rules that can include or exclude overtime, bonuses, concurrent employment, fringe benefits and short work histories in ways a general calculator cannot see. If our figure differs from the rate on your notice of benefits, the notice controls — and you can ask your agency's ombudsman or claims office how it was computed.
2. Not legal, tax or financial advice
Nothing on this site is legal advice, and using it does not create an attorney–client or any other professional relationship. Deadlines to report an injury and to file a claim are short in many states and missing them can forfeit benefits; contact your state agency or a licensed workers' compensation attorney in your state about your situation. Weekly workers' compensation benefits are generally not subject to federal income tax, but offsets against Social Security disability and other benefits can apply — ask a qualified professional.
3. Scope
The tool estimates temporary total disability and, where noted, temporary partial disability for private-sector and state/local public employees covered by a state workers' compensation act. It does not cover federal employees (FECA), longshore and harbor workers, seafarers (Jones Act), railroad workers (FELA), independent contractors, or employees whose state law exempts their employer. It does not estimate permanent disability awards, death benefits, medical benefits or settlements.
4. Accuracy and changes
We verify every figure against the state's own source and show the date we did so, but laws and rate notices change, agencies correct their own notices, and errors are possible. The site is provided "as is", without warranties of any kind, express or implied, including accuracy, completeness or fitness for a particular purpose. To the fullest extent permitted by law, the Workers' Comp Pay Calc Editorial Team is not liable for any loss arising from reliance on the site. Please report suspected errors through the corrections form.
5. Acceptable use
You may use the calculator for yourself, your family, your clients or your employees, and you may link to any page. Please do not scrape the site at a rate that degrades it for others, misrepresent its figures as an official agency determination, or frame its pages inside another site. The text, design and code are protected by copyright; the underlying statutes and agency figures belong to the public, and the sources page links every one so you can check them yourself.
6. Links to other sites
We link to state legislatures and workers' compensation agencies so you can verify our figures. We are not responsible for the content or availability of those sites.
7. Changes to these terms
We may update these terms; the date above shows the latest version. Continued use after a change means you accept the updated terms. Privacy practices are described separately in our privacy notice.
