New York rule sheet
| Benefit formula | Two-thirds of your average weekly wage.[1] |
|---|---|
| Maximum weekly | $1,281.50 a week for injuries Jul 1, 2026 – Jun 30, 2027 [2] |
| Minimum weekly | $384.45. If your wages are below the minimum, you receive your full wages.[2] |
| How the limits are set | Maximum = two-thirds of the New York state average weekly wage, reset each July 1. From July 1, 2026 the minimum is one-fifth of that average. |
| Waiting period | No pay for the first 7 days unless the disability extends beyond 14 days.[1] |
| How long TTD lasts | TTD paid during the continuance of temporary total disability; no fixed week cap for TTD. (PPD non-schedule awards are capped under §15(3)(w); TTD periods after PPD classification do not count against those caps.)[3] |
| Partial (TPD) | ⅔ × AWW × degree of disability % (for example 25% disabled = ⅔ × AWW × 25%); reduced-earnings benefit = 2/3 of the difference between current earnings and pre-injury AWW; subject to the weekly max.[4] |
| Average weekly wage | Gross earnings (including overtime) for the 52 weeks prior to the date of injury; 5-day worker: total pay ÷ days paid × 260 ÷ 52 (6-day: x300; 4-day/seasonal: x200)[5] |
Worked example, Oct 5, 2026
- Average weekly wage$1,000.00
- 66⅔% of wage$666.67
- Inside the $384.45–$1,281.50 band$666.67
- Off work 28 days: waiting days paid back, 28 days paid$2,666.68
- New York TTD per week$666.67
A higher earner at $2,500.00 a week would get $1,281.50 — the New York maximum, not $1,666.67. A worker earning $300.00 would get $300.00 (paid at the full wage).

What trips people up in New York
- Rate is fixed by date of injury; it does not rise when new max/min take effect.[6]
- If wages are below the minimum, the worker gets full wages (not the minimum).[1]
- Concurrent employment: wages from more than one employer may be combined in AWW.[5]
- Partial disability is paid by degree (25/50/75%) from medical reports, not by actual lost wages alone.[1]
- Minimum changed from flat $ to indexed 1/5 NYSAWW as of July 1, 2026; for 2026 injuries before July 1 the schedule still shows $325.[1]
