New Jersey rule sheet
| Benefit formula | 70% of your weekly wages at the time of injury.[1] |
|---|---|
| Maximum weekly | $1,199.00 a week for injuries Jan 1, 2026 – Dec 31, 2026 [2] |
| Minimum weekly | $320.00. The statute sets the minimum at 20% of the state average, without an exception for lower earners.[2] |
| How the limits are set | Maximum = 75% and minimum = 20% of the state average weekly wage, promulgated for each calendar year. |
| Waiting period | No pay for the first 7 days; if the disability lasts beyond 7 days, the waiting week is paid at once.[1] |
| How long TTD lasts | During the period of disability, not beyond 400 weeks.[1] |
| Partial (TPD) | No separate temporary partial disability wage-loss formula found in the DOL statute compilation; NJ pays temporary (total) disability while unable to work and under active medical care.[3] |
| Average weekly wage | Wages = money rate under the contract of hiring at time of accident. Hourly: hourly rate × customary hours in an ordinary day = daily wage; weekly wage = daily wage × customary working days in an ordinary week (part-week workers: hourly rate × hours regularly worked, for 34:15-12a only). Output/piece rate: earnings over preceding 6 months ÷ days worked. Board & lodging valued at $25/week unless fixed. Recorded tips: 6-month average added.[1] |
Worked example, Oct 5, 2026
- Average weekly wage$1,000.00
- 70% of wage$700.00
- Inside the $320.00–$1,199.00 band$700.00
- Off work 28 days: waiting days paid back, 28 days paid$2,800.00
- New Jersey TTD per week$700.00
A higher earner at $2,500.00 a week would get $1,199.00 — the New Jersey maximum, not $1,750.00. A worker earning $300.00 would get $320.00 (raised to the minimum).

What trips people up in New Jersey
- AWW is the contract wage rate × a customary full week, not an average of actual past paychecks.[1]
- Waiting-period days need not be consecutive.[1]
- Rates are by calendar year of injury (Jan 1 reset), not fiscal year.[1]
- Tips count only if a regular daily/weekly record was kept (else judge fixes amount).[1]
- TTD stops when the worker can return to work or is no longer under active medical care.[3]
