Maine rule sheet
| Benefit formula | Two-thirds of your gross average weekly wage (injuries since 2013; older injuries used 80% of after-tax wages).[1] |
|---|---|
| Maximum weekly | $1,561.40 a week for benefits paid Jul 1, 2026 – Jun 30, 2027 [2] |
| Minimum weekly | Maine's statute sets no minimum weekly benefit for total incapacity.[2] |
| How the limits are set | For injuries since 2020 the maximum is 125% of the state average weekly wage, and it applies by payment year: it resets every July 1 for benefits paid in the following twelve months. |
| Waiting period | No pay for the first 7 days of incapacity; if it continues more than 14 days, compensation is paid from the start. Firefighters have no waiting period.[3] |
| How long TTD lasts | Total incapacity: for the duration of the incapacity (no week cap). Partial incapacity (DOI on/after 2020-01-01) capped at 624 weeks of combined §212(1-A) + §213 compensation (520 weeks for DOI 2013-2019), extendable for extreme financial hardship. For DOI on/after 2020, after 260 weeks of §212 benefits an annual adjustment (lesser of SAWW change or 5%) applies.[1] |
| Partial (TPD) | DOI on/after 2020-01-01: 2/3 of the difference between pre-injury gross AWW and the gross wages the employee is able to earn after injury, subject to the §211 max; not payable after a total of 624 weeks under §212(1-A), §213(1)(C) or both.[4] |
| Average weekly wage | Amount the employee was receiving at time of injury for a regular full working week if the employment continued at least 200 full working days in the preceding year; otherwise total wages in the preceding year ÷ number of weeks any part of which was worked; seasonal workers: prior calendar-year wages ÷ 52; concurrent employers' wages combined; discontinued fringe benefits included only up to a benefit of 2/3 of 125% of SAWW (DOI on/after 2020).[5] |
Worked example, Oct 5, 2026
- Average weekly wage$1,000.00
- 66⅔% of wage$666.67
- Inside the $0.00–$1,561.40 band$666.67
- Off work 28 days: waiting days paid back, 28 days paid$2,666.68
- Maine TTD per week$666.67
A higher earner at $2,500.00 a week would get $1,561.40 — the Maine maximum, not $1,666.67. A worker earning $300.00 would get $200.00.

What trips people up in Maine
- The Weekly Benefit Tables (80% after-tax) must NOT be used to compute the rate for injuries on/after 2013-01-01; they are only for coordination of benefits under §221.[6]
- The maximum depends on the date-of-injury cohort (125% ÷ 100% ÷ 90% of SAWW) and is re-set every July 1 (payment period), not frozen at injury.[2]
- Discontinued fringe benefits count toward AWW only until the weekly benefit reaches 2/3 of 125% of SAWW ($1,040.93 for July 2026-June 2027, DOI on/after 2020).[5]
- Wages from concurrent employers are combined.[5]
- Firefighters have no waiting period.[3]
