New Hampshire rule sheet
| Benefit formula | 60% of your average weekly wage, or 30% of the state average weekly wage if that is greater.[1] |
|---|---|
| Maximum weekly | $2,309.00 a week for injuries Jul 1, 2025 – Jun 30, 2026 |
| Minimum weekly | $461.74. If your wage is at or below 30% of the state average, you receive your full wage, limited to 90% of your after-tax earnings. |
| How the limits are set | Maximum = 150% of the state average weekly wage, set each July 1 by the Department of Labor. The benefit also may not exceed 100% of your after-tax earnings — something only your own pay records can show. |
| Waiting period | No pay for the first 3 days; they are paid if the disability lasts 14 days or longer.[2] |
| How long TTD lasts | TTD while totally disabled, unable to return to work and not at maximum medical improvement; no week cap in RSA 281-A:28.[1] |
| Partial (TPD) | 60% of the difference between pre-injury AWW and post-injury earning ability, max per RSA 281-A:28 schedule; max 262 weeks, reduced by weeks of total disability.[3] |
| Average weekly wage | Gross earnings with the same employer over the preceding 26 weeks ÷ 26, or over 26-52 weeks ÷ that number of weeks, whichever is more favorable to the employee; short employment: rate of hire or comparable workers. Concurrent covered employers combined.[4] |
Worked example, Jul 1, 2025
- Average weekly wage$1,000.00
- 60% of wage$600.00
- Inside the $461.74–$2,309.00 band$600.00
- Off work 28 days: waiting days paid back, 28 days paid$2,400.00
- New Hampshire TTD per week$600.00
A higher earner at $2,500.00 a week would get $1,500.00. A worker earning $300.00 would get $300.00 (paid at the full wage).

What trips people up in New Hampshire
- Comp can never exceed 100% of after-tax weekly earnings (90% for low-wage workers), using the lowest exemptions claimed in the 26 weeks before injury.[4]
- Worker may choose any lookback from 26 to 52 weeks, whichever gives the higher AWW.[4]
- Concurrent employment wages count (extra paid by special fund).[4]
- TPD 262-week cap is reduced by weeks of total disability already paid.[3]
- Minimum is 30% of SAWW (greater-of rule), not a flat dollar amount.[1]
