Idaho rule sheet
| Benefit formula | 67% of your average weekly wage during the first 52 weeks; after that, 67% of the currently applicable state average weekly wage.[1] |
|---|---|
| Maximum weekly | $1,021.50 a week for injuries Jan 1, 2026 – Dec 31, 2026 [2] |
| Minimum weekly | $510.75. In the first 52 weeks the benefit cannot exceed 90% of your own wage; if 90% of your wage is below 15% of the state average, you get that 15% figure.[2] |
| How the limits are set | Maximum = 90% of the state average weekly wage and minimum = 45% of it, set each calendar year by the Industrial Commission. |
| Waiting period | No pay for the first 5 days; benefits are paid from the start if the disability lasts more than 2 weeks, and there is no waiting period if you are hospitalized as an inpatient.[3] |
| How long TTD lasts | During the period of recovery (no fixed week cap in 72-408); after 52 weeks rate becomes 67% of currently applicable ASW.[1] |
| Partial (TPD) | 67% of decrease in wage-earning capacity, not to exceed TTD benefit.[1] |
| Average weekly wage | By pay basis: weekly-fixed = that amount; monthly × 12 ÷ 52; yearly ÷ 52; hourly/daily/output = most favorable of the four 13-week periods in the 52 weeks before the accident, excluding overtime/premium pay; concurrent employers counted if employer knew.[4] |
Worked example, Oct 5, 2026
- Average weekly wage$1,000.00
- 67% of wage$670.00
- Inside the $510.75–$1,021.50 band$670.00
- Off work 28 days: waiting days paid back, 28 days paid$2,680.00
- Idaho TTD per week$670.00
A higher earner at $2,500.00 a week would get $1,021.50 — the Idaho maximum, not $1,675.00. A worker earning $300.00 would get $270.00 (paid at the full wage).

What trips people up in Idaho
- After 52 weeks of TTD the benefit switches to 67% of the CURRENT average weekly state wage (not the worker's AWW).[5]
- In the first 52 weeks the benefit can never exceed 90% of the worker's own AWW, even if that is below the 45%-of-ASW minimum.[6]
- 5-day waiting period is waived for in-patient hospitalization.[3]
- Concurrent employment wages are counted if the liable employer knew of the other job before the injury.[4]
- Hourly AWW uses the most favorable 13-week period in the prior 52 weeks and excludes overtime/premium pay.[4]
