Oregon rule sheet
| Benefit formula | 66⅔% of your wage, for injuries before 2027. For injuries from January 1, 2027, Senate Bill 1519 pays 75% of the wage up to 75% of the state average weekly wage plus 65% of the wage above that, up to 133% of it.[1] |
|---|---|
| Maximum weekly | $1,943.41 a week for injuries Jul 1, 2026 – Dec 31, 2026 [2] |
| Minimum weekly | $50.00. The minimum is $50 a week or 90% of your wage, whichever is less.[2] |
| How the limits are set | Maximum = 133% of the state average weekly wage. Oregon also raises ongoing benefits each July 1 with the state average wage, so a long claim's check changes over time. |
| Waiting period | No pay for the first 3 calendar days unless you are off 14 consecutive days or admitted to a hospital as an inpatient within 14 days.[1] |
| How long TTD lasts | No week cap; TTD continues until the first of: return to regular/modified work, written release to regular work, or written release to modified work that is offered in writing and not begun (ORS 656.268(4)).[1] |
| Partial (TPD) | The same share of your TTD rate as your wage loss is of your pre-injury wage (TTD rate × wage loss ÷ pre-injury wage). Partial benefits have their own 3-day waiting period.[1] |
| Average weekly wage | Worker's wage at time of injury: daily wage × number of days per week regularly employed (one job); for multiple jobs, all subject-employment earnings if insurer gets notice within 30 days and verifiable wage documentation within 60 days; director rules (OAR 436-060-0025) for irregular workers.[1] |
Worked example, Oct 5, 2026

- Off work 28 days: waiting days paid back, 28 days paid$2,666.68

What trips people up in Oregon
- TTD gets an automatic cost-of-living raise every July 1 equal to the SAWW increase (3.116% on 7/1/2026), so a long claim's weekly check changes over time.[2]
- Waiting period: first 3 calendar days unpaid unless off 14 consecutive days or hospitalized as inpatient within 14 days.[1]
- Second jobs count only if the insurer is told within 30 days of the claim and gets wage proof within 60 days of asking; otherwise only the job-at-injury wage is used.[1]
- Formula changes for injuries on/after Jan 1, 2027 (SB 1519): tiered 75%/65% instead of flat 66⅔%; older claims are not recalculated.[3]
- Minimum is tiny: the lesser of 90% of your wage or $50/week.[1]
