Maryland rule sheet
| Benefit formula | Two-thirds of your average weekly wage.[1] |
|---|---|
| Maximum weekly | $1,537.00 a week for injuries Jan 1, 2026 – Dec 31, 2026 [2] |
| Minimum weekly | $50.00. The minimum is $50 a week, or your average weekly wage if that is lower.[2] |
| How the limits are set | Maximum = 100% of the state average weekly wage, set by the Workers' Compensation Commission each January 1. |
| Waiting period | No pay for the first 3 days (an unpaid day of injury counts as one); if the disability lasts more than 14 days, it is paid from the first day.[3] |
| How long TTD lasts | For the period the employee is temporarily totally disabled; no statutory week cap found.[1] |
| Partial (TPD) | 50% of the difference between the AWW and the wage-earning capacity while temporarily partially disabled, not to exceed 50% of SAWW ($769.00 for 2026); paid for the period of temporary partial disability.[4] |
| Average weekly wage | Average of weekly wages when working full time at the time of injury, including tips and value of housing/lodging/meals (LE §9-602(a)). Employer wage statement: average wage during the 14 weeks before the accident, excluding involuntary layoff/authorized absences (COMAR 14.09.03.06B); preliminary award uses gross wages including overtime.[5] |
Worked example, Oct 5, 2026
- Average weekly wage$1,000.00
- 66⅔% of wage$666.67
- Inside the $50.00–$1,537.00 band$666.67
- Off work 28 days: waiting days paid back, 28 days paid$2,666.68
- Maryland TTD per week$666.67
A higher earner at $2,500.00 a week would get $1,537.00 — the Maryland maximum, not $1,666.67. A worker earning $300.00 would get $200.00.

What trips people up in Maryland
- AWW lookback is the 14 weeks before the accident (not a year), and overtime counts.[5]
- Short waiting period: only 3 days, and an unpaid injury day counts as one of them.[3]
- Temporary partial disability is only 50% (not 2/3) of the wage loss, capped at half the SAWW.[2]
- Tips and the value of employer-provided housing, lodging and meals are included in wages.[6]
- The maximum is set once per calendar year (January 1).[2]
