Virginia rule sheet
| Benefit formula | 66⅔% of your average weekly wage.[1] |
|---|---|
| Maximum weekly | $1,507.01 a week for injuries Jul 1, 2026 – Jun 30, 2027 [2] |
| Minimum weekly | $376.75. The minimum never exceeds your own average weekly wage.[2] |
| How the limits are set | The Workers' Compensation Commission sets the maximum and the minimum (25% of the state average weekly wage) each July 1. |
| Waiting period | No pay for the first 7 days; if the incapacity continues more than three weeks, they are paid.[3] |
| How long TTD lasts | Total compensation capped at 500 weeks (and 500 × SAWW), except permanent and total incapacity and certain other cases.[4] |
| Partial (TPD) | 66⅔% of the difference between pre-injury AWW and the AWW able to earn thereafter, not more than 100% of SAWW; prior TTD weeks are deducted from the partial-incapacity maximum (500 weeks total, §65.2-518)[5] |
| Average weekly wage | Earnings in the employment at injury during the 52 weeks before injury ÷ 52; if more than 7 consecutive calendar days were lost, those weeks are removed from the divisor; shorter employment uses weeks actually worked.[6] |
Worked example, Oct 5, 2026
- Average weekly wage$1,000.00
- 66⅔% of wage$666.67
- Inside the $376.75–$1,507.01 band$666.67
- Off work 28 days: waiting days paid back, 28 days paid$2,666.68
- Virginia TTD per week$666.67
A higher earner at $2,500.00 a week would get $1,507.01 — the Virginia maximum, not $1,666.67. A worker earning $300.00 would get $300.00 (paid at the full wage).

After Jun 30, 2027, the calculator asks you for the official maximum until Virginia publishes the new figure — it never guesses.
What trips people up in Virginia
- The weekly benefit can never exceed the worker's own AWW, so the $376.75 minimum does not apply in full to very low earners.[1]
- Max/min are locked to the July-1 year in which the injury occurred, for the whole time benefits are paid.[1]
- Gaps of more than 7 consecutive days off are removed when averaging the 52 weeks.[6]
- A COLA (2.65% effective Oct 1, 2026) applies only if compensation plus Social Security does not exceed 80% of AWW.[7]
