How the limits are setThe maximum equals the average weekly wage of insured employees in the District, which the Department of Employment Services computes before November 1 for the next calendar year from employer contribution reports (it changes only when the computation moves by $2 or more). The minimum for total disability is 25% of that maximum.
Waiting periodNo pay for the first 3 days of disability; if the disability lasts more than 14 days, compensation is allowed from the first day.[2]
How long TTD lastsTemporary total disability is paid while the disability lasts. For temporary or permanent partial disability from one injury, payments stop after 500 weeks in total unless an extension of up to 167 weeks is granted on an independent medical examiner's finding.[2]
Partial (TPD)66⅔% of your wage loss while partially disabled, for no more than 5 years.[1]
Average weekly wageBased on the wages you were earning at the time of injury, under the rules in § 32-1511 (full-time work in the year before injury, or comparable employees when your own history is short).[3]
