Kentucky rule sheet

Benefit formula66⅔% of your average weekly wage.[1]
Maximum weekly $1,277.99 a week for injuries Jan 1, 2026 – Dec 31, 2026 [2]
Minimum weekly$232.36. The statute sets the minimum at 20% of the state average weekly wage, with no exception for lower earners.[2]
How the limits are setMaximum = 110% and minimum = 20% of the state average weekly wage certified each year, applied to injuries in the following calendar year for the life of the claim.
Waiting periodNo pay for the first 7 days; if the disability lasts more than two weeks, benefits are paid from the first day.[3]
How long TTD lastsTTD lasts while the employee has not reached maximum medical improvement and has not improved enough to return to employment (KRS 342.0011(11)(a)); no fixed week cap in statute. All income benefits terminate at age 70 or 4 years after injury/last exposure, whichever is later (KRS 342.730(4)).[1]
Partial (TPD)No separate temporary partial disability formula applies.
Average weekly wageWeekly/monthly/yearly fixed wages converted directly (monthly × 12 ÷ 52; yearly ÷ 52). Hourly/daily/output wages: the most favorable of the four 13-consecutive-week periods in the 52 weeks before injury, divided by 13 (excluding overtime/premium pay); <13 weeks employed: projected 13-week wages. Seasonal: 1/50 of 12-month earnings. Concurrent employment counted if employer knew of it.[4]

Worked example, Oct 5, 2026

  1. Average weekly wage$1,000.00
  2. 66⅔% of wage$666.67
  3. Inside the $232.36–$1,277.99 band$666.67
  4. Off work 28 days: waiting days paid back, 28 days paid$2,666.68
  5. Kentucky TTD per week$666.67

A higher earner at $2,500.00 a week would get $1,277.99 — the Kentucky maximum, not $1,666.67. A worker earning $300.00 would get $232.36 (raised to the minimum).
