Illinois rule sheet
| Benefit formula | 66⅔% of your average weekly wage, computed without overtime or bonuses.[1] |
|---|---|
| Maximum weekly | $2,045.63 a week for injuries Jul 15, 2026 – Jan 14, 2027 [2] |
| Minimum weekly | $400.00. The minimum depends on your spouse and children under 18 ($400 with none, rising to $600 with four or more), but never more than your average weekly wage.[2] |
| How the limits are set | Maximum = 133⅓% of the state average weekly wage. Illinois posts new figures twice a year, on January 15 and July 15. |
| Waiting period | No pay for the first 3 working days; if the disability lasts 14 days or more, compensation is paid from the first day.[1] |
| How long TTD lasts | As long as the total temporary incapacity lasts (until return to work or MMI per IWCC handbook); no week cap.[1] |
| Partial (TPD) | Two-thirds of the difference between what the employee would be able to earn in full performance of the pre-accident occupation and the gross amount earned in the modified/other job (injuries on/after June 28, 2011 use gross)[1] |
| Average weekly wage | Actual earnings in the 52 weeks ending with the last full pay period before injury, excluding overtime and bonus, divided by 52 (or by weeks worked if 5+ calendar days lost or employed <52 weeks); concurrent employers counted if employer knew.[1] |
