What trips people up in South Dakota
- Low earners: if you earned less than half the maximum, your check is capped at 100% of your after-tax take-home pay (net of federal/state tax and FICA), so the 66⅔% ÷ minimum may not apply.[1]
- Max/min are set by the fiscal year of the injury date and apply for the whole time benefits are paid.[6]
- 7-day waiting rule: nothing paid unless incapacitated 7 consecutive days, but once met, paid back to the date of injury.[3]
- Temporary partial is only 50% of the wage difference (not 66⅔%), but can't be less than your TTD amount unless you refuse suitable work.[4]
- Permanent total disability benefits get an annual COLA (2.5% effective July 1, 2026).[2]
