What trips people up in North Dakota
- Benefit rate (and the max/min) is locked to the rates in effect on the date of FIRST disability, not the payment date.[1]
- Weekly benefit (plus dependency allowance) can never exceed the worker's take-home pay after Social Security and federal income tax - this can cut below the $775 minimum for low earners.[1]
- Concurrent covered employment counts: AWW is wages from all employments for which coverage is required or secured.[3]
- Adds $15/week per child dependency allowance on top of the disability benefit.[1]
- Recurrence after 3+ consecutive months back at work: benefits use the wage and WSI rates in effect at the recurrence.[1]
