Oklahoma rule sheet
| Benefit formula | 70% of your average weekly wage.[1] |
|---|---|
| Maximum weekly | $1,128.66 a week for injuries Jan 1, 2026 – Dec 31, 2026 |
| Minimum weekly | Oklahoma sets no minimum temporary total benefit. |
| How the limits are set | Maximum = 100% of the state average weekly wage, reset each January 1. |
| Waiting period | No pay for the first 3 days, and Oklahoma never pays them back.[1] |
| How long TTD lasts | 156 weeks; up to 52 additional weeks if an ALJ finds a consequential injury and medical necessity by clear and convincing evidence. Nonsurgical soft tissue injury: max 8 weeks (+8 with injection; up to +16 if surgery recommended) - 85A §62.[1] |
| Partial (TPD) | 70% of the difference between pre-injury AWW and the weekly wage for alternative work, only if alternative-work wage is less than the TTD rate; earnings + TPD may not exceed the TTD rate; max 52 weeks; refusing offered alternative work forfeits TTD/TPD.[1] |
| Average weekly wage | Gross earnings divided by number of full weeks of employment with the employer, up to 52 weeks; piece-rate: hourly equivalent × full-time hours; overtime averaged over weeks worked (max 52); Commission may use another just method.[1] |
Worked example, Oct 5, 2026
- Average weekly wage$1,000.00
- 70% of wage$700.00
- Inside the $0.00–$1,128.66 band$700.00
- Off work 28 days: 3 waiting days unpaid, 25 days paid$2,500.00
- Oklahoma TTD per week$700.00
A higher earner at $2,500.00 a week would get $1,128.66 — the Oklahoma maximum, not $1,750.00. A worker earning $300.00 would get $210.00.

What trips people up in Oklahoma
- Soft-tissue (sprain/strain, non-surgical) injuries: TTD capped at 8 weeks regardless of how many body parts.[1]
- First 3 days of TTD are never paid back (no retroactive rule).[1]
- Missing three consecutive medical appointments or not following doctor's orders lets the employer terminate TTD.[1]
- Refusing employer-offered alternative work ends both TTD and TPD.[1]
- Rate is 70% (not 66⅔%) of AWW and there is no minimum weekly benefit.
