Georgia rule sheet
| Benefit formula | Two-thirds of your average weekly wage.[1] |
|---|---|
| Maximum weekly | $800.00 a week for injuries from Jul 1, 2023 [1] |
| Minimum weekly | $50.00. The minimum is $50 a week, unless your average weekly wage is below $50, in which case you receive your wage.[1] |
| How the limits are set | Georgia's maximum is written into the statute rather than indexed: $800 a week for injuries on or after July 1, 2023, and it stays there until the legislature changes it. |
| Waiting period | No pay for the first 7 days; they are paid if the disability lasts 21 consecutive days.[2] |
| How long TTD lasts | Maximum 400 weeks from date of injury; catastrophic injuries paid until change in condition for the better.[1] |
| Partial (TPD) | Two-thirds of the difference between pre-injury AWW and the AWW the employee is able to earn thereafter, max $533/week (injuries on/after 7/1/2023; $483 before), up to 350 weeks from date of injury.[1] |
| Average weekly wage | Wages in the 13 weeks immediately preceding the injury if employee worked substantially the whole of the 13 weeks; else a similar employee's 13 weeks; else full-time weekly wage. Includes value of employer-furnished food/housing; includes wages from similar concurrent employment.[2] |
Worked example, Oct 5, 2026
- Average weekly wage$1,000.00
- 66⅔% of wage$666.67
- Inside the $50.00–$800.00 band$666.67
- Off work 28 days: waiting days paid back, 28 days paid$2,666.68
- Georgia TTD per week$666.67
A higher earner at $2,500.00 a week would get $800.00 — the Georgia maximum, not $1,666.67. A worker earning $300.00 would get $200.00.

What trips people up in Georgia
- Waiting-period days are calendar days counted from first day of disability even if not scheduled workdays.[2]
- Wages from similar concurrent employers must be included in AWW.[2]
- Max depends on date of injury: $800 applies to injuries on/after July 1, 2023; earlier injuries use older caps ($725 from 7/1/22, $675 from 7/1/19, ...).[3]
- Non-catastrophic TTD ends after 400 weeks from date of injury.[1]
- First payment of income benefits is due on the 21st day after employer knowledge; 15% late penalty if not paid when due.[2]
