What trips people up in Florida
- Max weekly rate is fixed by the calendar year in which the injury occurred (SAWW for four quarters ending June 30, used for injuries in the following calendar year).[3]
- Catastrophic injuries get 80% of AWW TTD for first 6 months from accident, and that rate is not subject to the s. 440.12(2) cap.[1]
- TTD stops at MMI or 104 weeks, whichever comes first; then impairment benefits are determined.[1]
- If concurrent-employment wages are used in AWW, the employee must supply the concurrent earnings information; interest/penalties/fees are waived while it is missing.[4]
- Benefits reduced if combined with Social Security disability they exceed 80% of AWW (offset ends at age 62).[1]
