Alabama rule sheet
| Benefit formula | 66⅔% of average weekly earnings at the time of injury.[1] |
|---|---|
| Maximum weekly | $1,219.00 a week for injuries Jul 1, 2026 – Jun 30, 2027 [2][3] |
| Minimum weekly | $335.00. If your average weekly earnings are below the minimum, you receive your full average weekly earnings instead of the minimum.[1] |
| How the limits are set | Maximum = no more than 100% of the state average weekly wage, as published by the department; minimum = 27½% of that wage, rounded to the nearest dollar. Both are set by June 1 for the year starting July 1. |
| Waiting period | No pay for the first 3 days of disability; those days are added to the first check once disability has lasted 21 days.[4] |
| How long TTD lasts | Paid for as long as the temporary total disability lasts — no week limit — but all compensation for one accident (except permanent total and scheduled injuries) is capped at 500 times the weekly maximum.[1][2] |
| Partial (TPD) | 66⅔% of the gap between your pre-injury average weekly earnings and what you can earn while partially disabled, up to 300 weeks.[1] |
| Average weekly wage | Wages earned in the job where you were hurt during the 52 weeks before the injury, divided by 52. Absences of more than 7 days in a row are taken out of the divisor; shorter work histories use the weeks actually worked or a comparable employee.[1] |
Worked example, Oct 5, 2026
- Average weekly wage$1,000.00
- 66⅔% of wage$666.67
- Inside the $335.00–$1,219.00 band$666.67
- Off work 28 days: waiting days paid back, 28 days paid$2,666.68
- Alabama TTD per week$666.67
A higher earner at $2,500.00 a week would get $1,219.00 — the Alabama maximum, not $1,666.67. A worker earning $300.00 would get $300.00 (paid at the full wage).

After Jun 30, 2027, the calculator asks you for the official maximum until Alabama publishes the new figure — it never guesses.
What trips people up in Alabama
- The maximum and minimum in force on the date of the accident stay with the claim for its whole life — a July 1 increase does not raise an existing claim's rate.[2]
- Permanent partial disability for non-scheduled injuries is capped at the lesser of $220 a week or the state average wage — far below the temporary total maximum — so the check can drop sharply once you reach maximum medical improvement.[2]
- The figures only change on July 1 if the state average wage moved by $2 or more; otherwise last year's maximum carries over.[2]
