What trips people up in Michigan
- The weekly rate is not a flat percentage of gross pay: it depends on tax filing status (4 statuses) and number of dependents, and the WDCA tables are legally conclusive.[6]
- Filing status is the employee's status on the date of injury; WDCA recommends carriers apply only Single and Married Filing Jointly unilaterally.[2]
- There is no minimum weekly benefit for total disability.[7]
- AWW uses the highest-paid 39 of the last 52 weeks and includes wages from all employment (concurrent jobs).[5]
- Maximum is fixed by the calendar year of injury (90% of SAWW, rounded up to the next dollar).[8]
