How the limits are setMaximum = 75% and minimum = 20% of the state average weekly wage, each rounded to the nearest dollar, for injuries from September 1 through August 31.
Waiting periodNo pay for the first week; if the disability lasts two weeks or longer, the first week is paid.[3]
How long TTD lastsNo week cap for TTD; it ceases when the condition has resolved enough for a reliable determination of disability and continued regular physician treatment is not required (R.S. 23:1221(1)(d)). SEB capped at 520 weeks (23:1221(3)(d)).[1]
Partial (TPD)Louisiana has no separate TPD benefit; the partial wage-loss benefit is Supplemental Earnings Benefits (SEB): payable monthly, 66⅔% of the difference between average monthly wages at injury (wages × 52 ÷ 12) and average monthly wages earned or able to be earned, when the employee cannot earn 90% or more of pre-injury wages; max 520 weeks; monthly SEB may not exceed 4.3 × the TTD max; no minimum.[1]
Average weekly wageHourly employees working 40+ hours: hourly rate × the greater of average actual hours in the four full weeks before the accident or 40 hours; part-time: hourly rate × average actual hours in the 4 full weeks; monthly salary × 12 ÷ 52; annual ÷ 52; piecework/commission: 26-week gross earnings ÷ days worked × average days per week; seasonal: annual income ÷ 52. Nontaxable benefits excluded except employee-elected pre-tax withholdings (for example health insurance) which are included.[4]
