What trips people up in Hawaii
- No retroactive payment of the 3-day waiting period appears in § 386-31(b) (first three calendar days excluded).[1]
- Being unable to complete a regular daily shift counts as a full day of total disability.[1]
- AWW can never be less than hourly rate × 35 (full-time); wages from all covered employment count.[4]
- If the employee was earning more at the time of injury than earlier in the year, AWW uses the higher wages only.[4]
- Employer must give 2 weeks' written notice before terminating TTD for ability to resume work; employee may request hearing.[1]
